11. Disclaimers and "as is" provision
11.1. The Site and its content are provided on an "as is" and "as available" basis.
11.2. To the maximum extent permitted by applicable law, we make no warranties or representations of any kind, whether express or implied, regarding the Site, including as to its accuracy, completeness, reliability, availability, uninterrupted operation, or fitness for any particular purpose.
11.3. Descriptions of RÜJ natural mineral water on the Site are presented for general and descriptive brand information only. We do not make any health, medical, wellness, or bodily-benefit claim about the RÜJ product.
11.4. We do not warrant that the Site will be free from errors, viruses, or other harmful components, or that defects will be corrected.
12. Limitation of liability
12.1. To the maximum extent permitted by applicable law, and subject to Section 12.3, KULTR shall not be liable for any indirect, incidental, special, or consequential loss or damage, or for any loss of profit, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of, or inability to use, the Site or your reliance on any content on it.
12.2. Subject to Section 12.3, our total aggregate liability arising out of or in connection with the Site and these Terms shall be limited to the maximum extent permitted by law.
12.3. Mandatory carve-out. Nothing in these Terms shall exclude or limit any liability that cannot lawfully be excluded or limited under Portuguese or European Union law. In particular, nothing in these Terms excludes or limits our liability for:
- (a) death or personal injury caused by our negligence;
- (b) fraud or fraudulent misrepresentation;
- (c) wilful misconduct or gross negligence (dolo ou culpa grave); or
- (d) any rights or remedies that consumers have under mandatory consumer-protection law, which are not affected by these Terms.
13. Indemnity
13.1. To the extent permitted by applicable law, and without affecting any mandatory consumer rights, you agree to indemnify and hold KULTR harmless against any third-party claims, liabilities, damages, and reasonable expenses arising out of or in connection with your breach of these Terms, your misuse of the Site, or your submission of unlawful or infringing content.
14. Privacy and cookies
14.1. Personal data that you submit through the "Request Access" form (your full name, your email address, and the optional "Restaurant, context" message), together with the IP address and submission time that our server records for anti-spam and security purposes, is processed by KULTR as data controller in order to evaluate and respond to your request, and, where you have given consent, to contact you about RÜJ access and to send you RÜJ communications. This personal data may be processed and stored outside your country, including in the United States, where our hosting and email infrastructure is located. Full details of how we handle personal data, including the legal bases, retention, the international-transfer mechanism we rely on, your rights, and how to contact us, are set out in our Privacy Policy.
14.2. The Site stores one strictly functional item in your browser to remember your chosen language. It uses no advertising or analytics cookies and no third-party trackers. Any further detail on cookies and similar technologies is provided in our Privacy Policy or Cookie information, as applicable.
14.3. For all data-protection and privacy matters, you may contact us at hello@iamruj.com.
15. Changes to these Terms
15.1. We may update or amend these Terms from time to time. The version in force is the one published on the Site, identified by its effective date.
15.2. Where a change is material, we will take reasonable steps to make it visible. Your continued use of the Site after a change takes effect constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, please stop using the Site.
16. Severability
16.1. If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
17. Entire agreement
17.1. These Terms, together with our Privacy Policy and any cookie information referenced on the Site, constitute the entire agreement between you and KULTR regarding your use of the Site, and supersede any prior understanding or arrangement on that subject.
18. Governing law and jurisdiction
18.1. These Terms and any matter arising out of or in connection with them or with your use of the Site are governed by the laws of Portugal.
18.2. The courts of Portugal shall have jurisdiction to settle any dispute, subject to Section 18.3.
18.3. If you are a consumer resident in the European Union, you continue to enjoy the protection of the mandatory provisions of the law of your country of habitual residence, and these Terms do not deprive you of that protection. Where applicable rules so provide, you may also bring proceedings in the courts of your place of residence.
19. Consumer dispute resolution
19.1. In the event of a dispute, we encourage you to contact us first at hello@iamruj.com so that we can try to resolve the matter.
19.2. Consumers in Portugal may have recourse to out-of-court alternative dispute resolution (resolução alternativa de litígios). The competent consumer-arbitration entity depends on your location and the nature of the dispute. The Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (CNIACC) has residual national competence where no regional centre is available, and regional consumer-arbitration centres operate in areas such as Lisbon, Porto, Coimbra, Braga, and the Algarve. A full list of competent entities is available at www.consumidor.pt.
19.3. The central consumer authority in Portugal is the Direção-Geral do Consumidor (www.consumidor.gov.pt).
19.4. You may also submit a complaint through the electronic Complaints Book (Livro de Reclamações eletrónico) at www.livroreclamacoes.pt.
19.5. This information is provided for consumers and does not by itself create any obligation on KULTR to submit to any particular dispute-resolution procedure, except as required by mandatory law.
